Terms of Use
Last updated: August 24, 2026. These Terms govern access to and use of Ecofyx. A paid subscription is also subject to the Subscription Agreement and to the conditions presented at checkout or in the applicable proposal.
1. Service provider
Ecofyx is a SaaS platform provided by TIAGO BONFIM FERNANDES, CNPJ 20.979.792/0001-03, established in Pindamonhangaba, São Paulo, Brazil. Contact: contato@ecofyx.com.
2. Acceptance, capacity and business use
By creating an account, subscribing to a plan or using the Platform, the User declares that they have the legal capacity to accept these Terms. Anyone using Ecofyx on behalf of an organization declares that they are authorized to bind that organization. The organization is responsible for account administration, granted permissions and the actions of its members and executors.
3. Key definitions
- Operation: an operational environment that brings together templates, forms, records, team members, alerts, results and settings.
- Template: an operational module composed of registrations, forms, indicators, lists, alerts, workflows and actions.
- Customer Content: responses, registrations, photos, files, locations, comments and other data entered by the Customer or its users.
- Creator/Administrator: a user authorized to structure operations, templates, teams, links and permissions.
- Executor: a person who fills out forms or records activities, either with an account or through controlled access.
- Execution link: an address or token that grants access to the scope defined by the Creator and may be subject to expiration and restrictions.
4. Purpose and limits of the Platform
Ecofyx allows operational routines to be organized into customized templates, forms and registrations; evidence to be recorded; teams to be organized; indicators, alerts, history and results to be monitored; and information to be exported. Map resources may use points, areas and location validation.
Ecofyx is an operational support tool. It does not replace professional opinions, reports, technical responsibility, on-site inspection, industrial automation systems, ERP, CRM, TMS, SCADA, regulated medical records, forensic chain of custody or any specific legal obligation. The Customer must assess whether the configuration and use meet the requirements applicable to its sector.
5. Accounts, teams, credentials and links
- Registration information must be truthful and kept up to date.
- When the User chooses Continue with Google, Google acts only as the authentication provider. Ecofyx uses the basic identity data needed to create or link the account and does not request access to the contents of Gmail, Google Drive, Google Calendar or Google Contacts for this sign-in.
- Passwords, tokens and links must be kept confidential and must not be shared with unauthorized people.
- The account owner must review team permissions and revoke access when it is no longer required.
- Temporary links operate as credentials within the granted scope. The Creator is responsible for their distribution, validity and revocation.
- Suspected unauthorized access must be reported to support immediately.
6. Customer Content, data and Customer responsibilities
The Customer retains rights over Customer Content and grants Ecofyx a limited authorization to store, process, transmit, display, copy for backup and perform other operations necessary to provide the service.
- The Customer is responsible for the lawfulness, quality, accuracy and necessity of the data entered.
- The Customer must have the appropriate legal basis, notices, authorizations and internal policies to collect data from employees, contractors, customers or third parties.
- Sensitive personal data should be entered only when strictly necessary and with safeguards appropriate to the risk.
- The Customer must avoid excessive collection and grant access only to people who need it.
- Ecofyx does not automatically validate the truthfulness or technical or legal compliance of records.
7. Geolocation, photos and evidence
Location, date, time, photos and files may be used as operational evidence. These resources depend on device accuracy, browser permissions, GPS signal, connectivity, device time and the quality of submitted content. The Customer must obtain appropriate authorizations and provide information to people who are monitored or photographed.
8. Artificial-intelligence resources
Ecofyx may provide prompts, suggestions or structures created with artificial-intelligence assistance to create or improve templates and forms. These outputs are assistive, may contain omissions or unsuitable content and must be reviewed by the User before publication. The decision to use, adapt or discard a suggestion is made by a person. Ecofyx does not guarantee that an AI-generated structure complies with legislation, technical standards or a specific process.
9. Permitted use and prohibited conduct
Users must not:
- access data, accounts or areas without authorization;
- bypass security controls, limits, billing controls or permissions;
- insert malware, exploit vulnerabilities, perform invasive testing without authorization or cause service unavailability;
- use the Platform for unlawful, discriminatory or fraudulent content or activities, or for activities that infringe third-party rights;
- resell, sublicense, improperly copy or improperly reverse engineer the Platform;
- use public links to expose personal data or confidential information indiscriminately.
10. Plans, billing and changes to limits
Plans, prices, billing frequency, limits and resources are stated on the pricing page, at checkout or in the applicable proposal. Applicable taxes may form part of the price. Late or failed payment may result in notice, limitation, suspension or cancellation, subject to the contracted conditions and applicable law.
The Customer may request a plan change or cancellation through the available resources or the stated contact channel. Consumer rights, including any legally applicable right to withdraw from a distance contract, are preserved. See the Cancellation and Refund Policy.
11. Availability, maintenance and support
The Provider uses reasonable efforts to keep the service available, but maintenance, updates and failures involving internet access, hosting, maps, email, payments or other third parties may occur. No SLA is guaranteed unless specifically contracted. Standard support is provided through the digital channels stated on the site and may vary by plan.
12. Backups, exports and continuity
Ecofyx may maintain technical backups for continuity and environment recovery. Backups do not replace the Customer's obligation to export and retain information essential to its activity. Before deleting an account or ending a subscription, the Customer should use the available Results and export tools.
13. Security and incidents
The Provider adopts technical and administrative measures appropriate to the nature of the service, including access controls, session protection, logical separation, request validation, technical logs, backups and monitoring. No environment is completely immune from risk. If a risk is identified, the Provider may block credentials, links, features or accounts for containment.
Relevant incidents involving personal data will be assessed and communicated according to the parties' roles and applicable law. When the Customer acts as Controller, it must cooperate with the measures and communications under its responsibility.
14. Third-party services
Operation may depend on hosting, email, payment, mapping, authorized analytics, storage and support providers. Each external service may have its own terms. Ecofyx does not control outages or changes affecting those providers but will seek reasonable alternatives when necessary.
15. Intellectual property
The Ecofyx brand, code, interfaces, components, documentation and materials belong to the Provider or its licensors. Use of the Platform grants a limited, revocable, non-exclusive and non-transferable license for the duration of the account or subscription. Customer Content remains owned by its respective owner.
16. Suspension and termination
An account may be suspended or terminated upon request, for non-payment, security risk, unlawful use, breach of these Terms or a legal requirement. Whenever possible and compatible with security, a reasonable opportunity will be provided to remedy the issue or export data. Data may be retained where necessary for legal obligations, billing, security, fraud prevention or the exercise of rights.
17. Liability
Each party is liable for the damage it causes within the limits of applicable law. The Provider is not liable for technical or operational decisions made exclusively by the Customer, inaccurate data entered by users, use outside the intended purpose, device or connection failures, improper credential sharing or acts of third parties beyond its control. Nothing in these Terms excludes liability that cannot legally be excluded or restricts consumer rights guaranteed by law.
18. Changes
These Terms may be updated to reflect legal, technical or commercial changes. Material changes will be communicated reasonably. When a change requires new consent or acceptance, Ecofyx will request the appropriate confirmation.
19. Applicable law and contact
Brazilian law applies. Jurisdiction will be determined according to applicable law, preserving the consumer's place of residence where required. Questions, requests or notices: contato@ecofyx.com.
20. Regulatory references
These Terms take into account, among other applicable rules, the Brazilian General Data Protection Law (LGPD), the Brazilian Internet Civil Framework, the Consumer Protection Code and Brazilian e-commerce rules.
